European Union (EU)* : Result of Reinvestigation of the Anti-dumping Measures on Imports of Sulphanilic Acid Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 182/2003 of 8 July 2003, the Council of the EU has published a regulation to amend the definitive anti-dumping duty imposed on imports of sulphanilic acid originating in, inter alia, the mainland of China subsequent to a reinvestigation. A copy of the regulation is at Annex (pdf format)for reference. Salient points are set out below-

(a) Product  : Sulphanilic acid classifiable within CN code ex 2921 4210 (TARIC code 2921 4210 60). The CN code is given for information only.
(b) Revised Duty Rate : 33.7% of the net, free-at-Community-frontier price before duty
(c) Effective Date 13 February 2004


DETAILS

  1. Definitive anti-dumping duty on imports of sulphanilic acid originating in, inter alia, the mainland of China had been imposed since 26 July 2002 at a rate of 21% of the net, free-at-Community-frontier price before duty.
  2. On the basis of a complaint lodged by Sorochimie and Quimigal, two producers representing 100% of the Community production of sulphanilic acid, the European Commission initiated a reinvestigation on 26 June 2003. The complainants alleged that the anti-dumping measures in force had not led to sufficient movement in the prices in the Community.
  3. Subsequent to the reinvestigation, the European Commission concluded that absorption of the anti-dumping duty had taken place. Furthermore, the dumping margin was found to have increased to 33.7%, in comparison with 21% as established in the original investigation. The level of the anti-dumping duty should therefore be revised to reflect the new dumping margin.
