Commercial Information Circular No. 298/2004

European Union (EU)* : Notice Regarding the Product Scope of the Anti-dumping Proceeding Concerning Imports of Trichloroisocyanuric Acid Originating in the Mainland of China

Further to Commercial Information Circular No. 174/2004 of 16 July 2004, the European Commission (the Commission) published a notice to invite interested parties to submit information again concerning the anti-dumping proceeding on imports of trichloroisocyanuric acid originating in the mainland of China. This is prompted by the fact that the questionnaires sent by the Commission to interested parties in July 2004 did not cover the full product concerned as defined in the notice of initiation of investigation. The Commission will now use new questionnaires for the investigation in order to ensure that it obtains the full information. A copy of the Commission's notice is at Annex (pdf format) for reference. Salient points are set out below-

(a) Date of Publication of the Notice  : 20 November 2004
(b) Product Coverage : Trichloroisocyanuric acid (also referred to as 'symclosene' under the international non-proprietary name) as well as preparations thereof, normally declared within CN codes ex 2933 69 80 and ex 3808 40 20 (these CN codes are given for information only).
(c) Procedures :

In order to obtain necessary information for the investigation, the Commission will send new questionnaires to the Community industry, any association of producers in the Community, the sampled exporters/producers in the mainland of China, any association of exporters/producers, importers, any association of importers named in the complaint, and the authorities of the mainland of China.

Interested parties should, within 15 days from 20 November 2004, contact the Commission by fax to find out whether they are listed in the complaint and, if necessary, request a questionnaire, given all questionnaire replies must be submitted to the Commission within 40 days from 20 November 2004, unless otherwise specified.

All interested parties, if their representations are to be taken into account, must make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission within 40 days from 20 November 2004, unless otherwise specified. They may also apply to be heard by the Commission within 40 days from 20 November 2004.

All correspondence must be made in writing (not in electronic format, unless otherwise specified) indicating the name, address, e-mail address, telephone and fax, and/or telex numbers of the interested party and should be made to the following address :

(d) Investigation Schedule : Provisional measures may be imposed no later than nine months from 10 July 2004 (i.e. the date of the publication of the notice of initiation of the anti-dumping proceeding on the product concerned). Investigation will be concluded within 15 months from 10 July 2004.
