Commercial Information Circular No. 262/2004

European Union (EU)* : Tariff Quota on Imports of Garlic Originating in the Mainland of China

Further to Commercial Information Circular No. 188/2004 of 31 July 2004, we have received information concerning the issue of import licences by the European Commission (the Commission) for garlic originating in the mainland of China. Details are set out in Commission Regulation (EC) No. 1798/2004 (the Regulation), a copy of which is attached (pdf format)  to this circular for reference.

DETAILS

  1. Commercial Information Circular No. 80/2002 of 19 April 2002 informed the trade, among other things, of the Commission's rules for managing tariff quota# for garlic (CN code 0703 2000) originating in the mainland of China. Since the applications received on 11 and 12 October 2004 already exceeded the available quantities of tariff quota, the Commission has enacted the Regulation announcing that:
    1. import licence applications for garlic originating in the mainland of China lodged on 11 and 12 October 2004 and sent to the Commission on 14 October 2004 shall be issued at the rate of 11.177% and 0.788% of the applied quantities for traditional importers and new importers respectively; and
    2. applications lodged after 12 October 2004 for the quarter running from 1 December 2004 to 28 February 2005 shall be rejected.

# The tariff quota allows garlic to be imported into the EU at reduced duty rate up to the quota limit. The normal duty rate will resume when imports reach the quota limit.
