European Union (EU)* : Result of Expiry and Interim Reviews of the Anti-dumping Measures on Imports of Glyphosate Originating in the Mainland of China
Further to Commercial Information Circular No. 59/2003 of 21 February 2003, the Council of the EU (the Council) has published a regulation announcing the decision to maintain the anti-dumping duty imposed on imports of glyphosate originating in the mainland of China consequent to an expiry review; and also to extend the said anti-dumping duty to imports of the same products consigned from Malaysia or Chinese Taipei, whether declared as originating in Malaysia or Chinese Taipei or not. Furthermore, the original anti-dumping duty was lowered from 48% to 29.9% as a result of an interim review. A copy of the regulation is at Annex (pdf format) for reference. DETAILS
- The Council imposed on 19 February 1998 a definitive anti-dumping duty on imports of glyphosate originating in the mainland of China at a rate of 24% of the net, free-at-Community-frontier price before duty. Following an interim review, the anti-dumping duty has been revised to 48% since 26 May 2000. Based on the findings of the circumvention investigation, the Council has decided that with effect from 1 February 2002, the definitive anti-dumping duty imposed on imports of glyphosate was extended to imports of the same products consigned from Malaysia or Chinese Taipei, whether declared as originating in Malaysia or Chinese Taipei or not.
- On 18 November 2003, the European Glyphosate Association requested an expiry review alleging that there would be a continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping duty. Also, the European Commission (the Commission) decided on its own initiative to initiate an interim review in order to examine the appropriateness of the anti-dumping measures, as the evidence presented in the request for expiry review showed that the level of the measures was not sufficient to counteract the injurious dumping practices. The Commission therefore initiated an expiry and an interim review on 15 February 2003.
- On the basis of the results of the review investigations, the Commission concluded that dumping of the product concerned was currently taking place and that there would be likelihood of a recurrence of injurious dumping if the duty was repealed. Furthermore, the dumping margin was found to have decreased to 29.9%, in comparison with 48% as established in the previous interim review investigation. The Council of the EU therefore decided to maintain the definitive anti-dumping measures imposed on the subject product, and lowered the level of the anti-dumping duty to reflect the new dumping margin.
