European Union (EU)* : Initiation of an Expiry Review of the Anti-dumping Measures  on Imports of Steel Ropes and Cables Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 283/2003 of 20 November 2003, the European Commission (the Commission) has published a notice to initiate an expiry review of the anti-dumping measures imposed on imports of steel ropes and cables originating in, inter alia, the mainland of China. DETAILS

Grounds for the Review

  1. On the basis of a request lodged by the Liaison Committee of European Union Wire Rope Industries (the applicant), the Commission initiated the expiry review on 17 August 2004. The applicant claimed that there would be continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures.

Review Procedure

  1. Salient points of the expiry review are set out below-
(a) Date of Publication of the Notice : 17 August 2004
(b) Product Coverage : Steel ropes and cables, classifiable within CN codes ex 7312 10 82, ex 7312 10 84, ex 7312 10 86, ex 7312 10 88 and ex 7312 10 99 (TARIC codes 7312 10 82*10, 7312 10 84*10, 7312 10 86*10, 7312 10 88*10 and 7312 10 99*10) (these CN codes are given for information only).
(c) Procedures :

In view of the apparent large number of parties involved in the proceedings, the Commission may apply sampling technique. Exporters/producers, or representatives acting on their behalf should, within 15 days from 17 August 2004, make themselves known to the Commission and provide information requested in paragraph 5.1 (a) (i) of the notice in question, including contact details, turnover, activities of their company/companies, and indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation.

In order to obtain necessary information for the investigation, the Commission will send questionnaires to the sampled Community industry, any association of producers in the Community, sampled exporters/producers in the mainland of China, any association of exporters/producers, sampled importers, any association of importers named in the complaint, and the authorities of the mainland of China

Exporters/producers sampled must reply to the questionnaires within 37 days from the date of the notification of their inclusion in the sample.

Interested parties who did not co-operate in the investigation leading to the measures subject to the present review should request a copy of the questionnaire within 15 days from 17 August 2004.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission within 40 days from 17 August 2004, unless otherwise specified. They may also apply to be heard by the Commission within 40 days from 17 August 2004.

Background

  1. Definitive anti-dumping duty on imports of steel ropes and cables originating in, inter alia, the mainland of China has been imposed since 18 August 1999. The rate of duty is 60.4% of the net, free-at-Community-frontier price before duty.
