European Union (EU)* :Initiation of An Interim Review of the Anti-dumping Measures Imposed on Imports of Bicycles Originating in the Mainland of China

Further to Commercial Information Circular No. 170/2001 of 7 November 2001, the European Commission (the Commission) has published a notice to initiate an interim review of anti-dumping measures imposed on imports of bicycles originating in the mainland of China. A copy of the notice is at Annex (pdf format) for reference.

DETAILS

Grounds for the Review

  1. On the basis of a request lodged by the European Bicycles Manufacturers Association (the applicant), the Commission initiated the interim review on 29 April 2004. The applicant claimed that dumping and injury had recurred and that the existing measures were no longer sufficient to counteract the injurious dumping.

Review Procedure

  1. Salient points of the interim review are set out below-

(a) Date of Publication of the Notice : 29 April 2004
(b) Product Coverage : Bicycles and other cycles (including delivery tricycles), not motorised, classifiable within CN codes 8712 0010, 8712 0030 and 8712 0080 (these CN codes are given for information only).
(c) Procedures :

In view of the apparent large number of parties involved in the proceedings, the Commission may apply sampling technique. Exporters/producers, or representatives acting on their behalf should, within 15 days from 29 April 2004, make themselves known to the Commission and provide information requested in paragraph 5.1 (a) (i) of the notice in question, including contact details, turnover, indication of intention to claim an individual margin, activities of their company/companies, and indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation.

In order to obtain necessary information for the investigation, the Commission will send questionnaires to the sampled Community industry, any association of producers in the Community, sampled exporters/producers in the mainland of China, any association of exporters/producers, sampled importers, any association of importers named in the request or which co-operated in the investigation leading to the measures subject to the present review, and the authorities of the mainland of China.

Exporters/producers sampled must reply to the questionnaires within 37 days from the date of the notification of their inclusion in the sample.

The Commission will send market economy status claim forms to all exporters/producers named in the review request and to any association of exporters/producers named in the review request, and to the authorities of the mainland of China.

Exporters/producers claiming market economy status and/or individual treatment should submit duly substantiated claim forms to the Commission within 15 days from 29 April 2004.

Exporters/producers requesting for an individual margin should, within 10 days from 29 April 2004, request a copy of the questionnaire from the Commission. They must submit a completed questionnaire within 40 days from 29 April 2004, unless otherwise specified.

Exporter/producers claiming individual margin should however note that if sampling is applied, the Commission may decide not to calculate an individual margin for them if the number of exporters/producers is so large that individual examination would be unduly burdensome and would prevent the timely completion of the investigation.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the Commission within 40 days from 29 April 2004, unless otherwise specified. They may also apply to be heard by the Commission within 40 days from 29 April 2004.

Background

  1. The Council of the EU imposed on 10 September 1993 a definitive anti-dumping duty on imports of bicycles originating in the mainland of China at a rate of 30.6% of the net, free-at-Community-frontier price before duty. Consequent to an expiry review, the duty has been extended for another five years since 15 July 2000.
