Dear Sirs,

Commercial Information Circular No. 116/2004

European Union (EU)* :Suspension of the Placing on the Market and Import of Jelly Mini-cups Containing Certain Food Additives

The European Commission (the Commission) has adopted a Decision to suspend the placing on the market and import of jelly mini-cups containing certain additives derived from seaweed and/or certain gums. The use of the additives concerned in jelly mini-cups is also prohibited. Details are set out in Commission Decision (2004/374/EC), a copy of which is attached (pdf format) to this circular for reference.

DETAILS

  1. On the basis of the information provided by several Member States, the Commission concluded that jelly mini-cups containing additives derived from seaweed and/or certain gums could pose a choking risk which might be life-threatening. The shape, size and manner of ingestion of the jelly mini-cups as well as the chemical and physical properties of the additives are the cause of concern. Furthermore, warnings through labelling are considered insufficient to protect human health, especially with regard to children. Community-wide measure to suspend the placing on the market and import of jelly mini-cups containing the additives in question is therefore deemed necessary to ensure a high level of consumer protection.
