European Union (EU)* : Extension of the Definitive Anti-dumping Duty on Imports of Glyphosate Originating in the Mainland of China to Imports of Glyphosate Consigned from Chinese Taipei or Malaysia (Whether Declared as Originating in Chinese Taipei or Malaysia or Not)

Further to Commercial Information Circular No. 89/2001 of 15 May 2001, the Council of the EU has published a regulation in the Official Journal of the European Communities to extend the definitive anti-dumping duty imposed on imports of glyphosate originating in the mainland of China to imports of glyphosate consigned from Chinese Taipei or Malaysia, whether declared as originating in Chinese Taipei or Malaysia or not. A copy of the regulation is appended (pdf format) to this circular for reference. Details are set out below.

DETAILS

2. (a) Product : Glyphosate classifiable within CN codes ex 2931 0095 and ex 3808 3027 consigned from Chinese Taipei or Malaysia whether declared as originating in Chinese Taipei or Malaysia or not, with the exception of those produced by Sinon Corporation in Chinese Taipei and by Crop Protection (M)Sdn. Bhd. in Malaysia respectively.
(b) Rate of Definitive Duty : 48% of the net, free-at-Community-frontier price before duty.
(c) Effective Date : 1 February 2002. Duty shall also be levied on imports of the product concerned which have been registered with the EU customs authorities since 10 May 2001.
(d) Requests for Exemption : Requests for exemption from the duty extended shall be made in writing in one of the official languages of the Community and must be signed by a person authorized to represent the applicant. Applicants have to provide all relevant information, in particular any modification in the company's activities linked to production and export sales. BACKGROUND

  1. The Council of the EU imposed on 19 February 1998 a definitive anti-dumping duty on imports of glyphosate originating in the mainland of China. The rate of duty was 24% of the net, free-at-Community-frontier price before duty. Following an interim review, the rate of duty has been revised to 48% since 26 May 2000. Subsequently, the European Glyphosate Association lodged a complaint on the alleged circumvention of the subject anti-dumping duty by imports consigned from Chinese Taipei or Malaysia. Having considered the case, the European Commission initiated an anti-circumvention investigation on 10 May 2001 and made the product concerned consigned from Chinese Taipei or Malaysia subject to registration for nine months.

On the basis of the results of the investigation, the Commission concluded that imports of glyphosate from Chinese Taipei or Malaysia had circumvented the anti-dumping duty imposed on imports of glyphosate originating in the mainland of China. The Council of the EU has therefore decided, with effect from 1 February 2002, to extend the anti-dumping duty at a rate of 48% to imports of glyphosate consigned from Chinese Taipei or Malaysia (whether declared as originating in Chinese Taipei or Malaysia or not), with the exception of those produced by the two companies named in paragraph 2(a) above. The duty extended shall also be collected on imports of glyphosate registered since 10 May 2001.
