European Union (EU)* : Initiation of Expiry Review of the Anti-dumping Measures on Imports of Certain Ring Binder Mechanisms Originating in the Mainland of China

Further to Commercial Information Circular No. 81/2001 of 3 May 2001, the European Commission (EC) has initiated an expiry review of the anti-dumping measures on imports of certain ring binder mechanisms originating in the mainland of China. A copy of the notice initiating the review is at Annex (pdf format)for reference. Details are set out below.

DETAILS

2. a Date of Notice : 24 January 2002
b Product Coverage : Ring binder mechanisms consisting of two rectangular steel sheets or wires with at least four half-rings made of steel wire fixed on it and which are kept together by a steel cover, opened either by pulling the half-rings or by using a small steel-made trigger mechanism fixed to the ring binder mechanisms, and classifiable under CN code ex 8305 1000 (the CN code is given for information only).
c Procedures :

In order to obtain information for the investigation, the EC will send questionnaires to the Community industry, any association of producers in the Community, exporters/producers, any association of exporters/producers, importers, any association of importers named in the request or which cooperated in the investigation leading to the measures subject to the present review, and the authorities of the mainland of China.

Interested parties who did not cooperate in the investigation leading to the measures subject to the present review should request a copy of the questionnaire within 15 days from 24 January 2002.

All interested parties may make their views known in writing and provide supporting evidence to the EC within 40 days from 24 January 2002 unless otherwise specified. They may also apply to be heard by the EC within 40 days from 24 January 2002.

  1. The EC initiated the review on the basis of a request lodged by Koloman Handler AG and Krause Ring-buchtechnik GmbH on 24 October 2001. It was alleged that there would be continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures.
     
  2. The existing anti-dumping measures will remain valid until completion of the expiry review. Definitive anti-dumping duties on certain ring binder mechanisms originating in the mainland of China have been imposed since 25 January 1997. The rate of duty for mechanisms with 17 and 23 rings was the difference between the minimum import price of ECU 325 per 1,000 pieces and the free-at-Community-frontier not cleared through customs price. The rate of duty for mechanisms other than those with 17 or 23 rings was 39.4% of the net, free-at-Community-frontier price before duty except for one company at 32.5%. Following an interim review, the rate of duty has been revised since 6 October 2000. The revised rate for mechanisms other than those with 17 or 23 rings is 78.8% of the net, free-at-Community-frontier price before duty (except for one company at 51.2%) while the duty rate for mechanisms with 17 and 23 rings is maintained.
