European Union (EU) * : Notice of Initiation of a Reinvestigation of the Anti-dumping Measures on Imports of Integrated Electronic Compact Fluorescent Lamps (CFL-i) Originating in the Mainland of China

Further to Commercial Information Circular No. 115/2001 of 31 July 2001, the European Commission (EC) has initiated a reinvestigation on whether the existing anti-dumping measures on imports of integrated electronic compact fluorescent lamps (CFL-i) originating in the mainland of China have had an effect on resale prices or subsequent selling prices in the Community. A copy of the notice initiating the reinvestigation is at Annex  (pdf format) for reference. Salient points are set out below -

(a) Date of Notice : 10 October 2002
(b) Product Coverage : Electronic compact fluorescent discharge lamps with one or more glass tubes, with all lighting elements and electronic components fixed to the lamp foot or integrated in the lamp foot, and classifiable under CN code ex 8539 3190 (this CN code is given for information only).
(c)Procedures : In view of the apparent large number of importers involved, the EC may apply sampling technique. All unrelated importers, or representatives acting on their behalf should, within 15 days from 10 October 2002, make themselves known to the EC and provide information requested in paragraph 5 (a) of the notice, including turnover, activities of their company/companies, indication of agreement for being included in the sample which implies replying to a questionnaire and accepting an on-the-spot investigation of their response. Questionnaire replies from sampled parties must reach the EC within 37 days from the date of the notification of their inclusion in the sample.

In order to obtain information for the investigation, the EC will send questionnaires to all exporting producers, which cooperated in the original investigation leading to the measures subject to the present reinvestigation, any association of exporters/producers, importers, any association of importers named in the request or which cooperated in the investigation leading to the measures subject to the present reinvestigation, and the authorities of the mainland of China.

Interested parties should request a copy of the questionnaire within 15 days from 10 October 2002.

All interested parties may make their views known in writing (including submitting questionnaire replies) and provide supporting evidence to the EC within 40 days from 10 October 2002 unless otherwise specified. They may also apply to be heard by the EC within 40 days from 10 October 2002.

  1. The EC initiated the reinvestigation on the basis of a request lodged by the Establishing Legal Lighting Competition Federation on behalf of producers representing more than 90% of the total Community production of integrated electronic compact fluorescent lamps (CFL-i). It was alleged that the existing anti-dumping measures have not led to any movement or sufficient movement in resale prices or subsequent selling prices in the Community, which has impeded the intended remedial effects of the measures in force.
     
  2. The existing anti-dumping measures will remain valid until completion of the reinvestigation. Definitive anti-dumping duties on integrated electronic compact fluorescent lamps originating in the mainland of China have been imposed since 20 July 2001. The rate of duty is 66.1% of the net, free-at-Community-frontier price before duty (except for eight companies with individual duty rates ranging from 0% to 59.5%).
