Commercial Information Circular No. 178/2002

European Union (EU)*: Result of Review of the Anti-dumping Duty on Imports of Colour Television Receivers Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 47/00 of 11 April 2000, the Council of the EU has published a regulation in the Official Journal of the European Communities announcing the decision to maintain the definitive anti-dumping duty imposed on imports of colour television receivers originating in, inter alia, the mainland of China consequent to an expiry and interim review. A copy of the regulation is appended (pdf format) to this circular for reference. Salient points are set out as follows :

(a) Product : Colour television receivers with a diagonal screen size of more than 15.5cm, whether or not combined in the same housing with a radio broadcast receiver and/or clock, other than those incorporating a modem and a computer operating system, classifiable within CN codes ex 8528 1252, ex 8528 1254, ex 8528 1256, ex 8528 1258, ex 8528 1262 and ex 8528 1266.
(b) Rate of Duty : 44.6% of the net, free-at-Community-frontier price before duty
(c) Effective Date : 30 August 2002

BACKGROUND

  1. The Council of the EU imposed on 3 December 1998 a definitive anti-dumping duty on imports of colour television receivers originating in the mainland of China at a rate of 44.6%. Following the publication of a notice of impending expiry of the anti-dumping duty, the Producers of European Televisions in Cooperation (Poetic) requested an expiry review alleging that there would be a continuation or recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping duty. The request also contained information showing that the various markets involved and the product itself had undergone significant changes over the last few years. The European Commission therefore initiated an expiry and interim review on 1 April 2000.
     

  2. On the basis of the results of the review, the Commission concluded that there was dumping of the product concerned and there would be likelihood of recurrence of injurious dumping if the duty was repealed. The Council of the EU therefore decided to maintain the definitive anti-dumping duty imposed on imports of colour television receivers originating in the mainland of China. The duty has taken effect since 30 August 2002.
