European Union (EU) * : Exemption from the Extension to Certain Essential Bicycle Parts of the Anti-dumping Duty Imposed on Imports of Bicycles Originating in the Mainland of China and Revoking the Exemption from the Payment of the Anti-dumping Duty Extended to Certain Bicycle Parts Originating in the Mainland of China

Further to Commercial Information Circular No. 91/2002 of 8 May 2002, the European Commission (EC) has published a decision in the Official Journal of the European Communities to (a) exempt some bicycle assemblers from the extension of the anti-dumping duty imposed on imports of bicycles originating in the mainland of China; and (b) revoke the exemption from the payment of the extended anti-dumping duty granted to certain bicycle assemblers. A copy of the decision is appended (pdf format) to this Circular for reference.

DETAILS

  1. Based on the findings of a circumvention investigation, the Council of the EU extended with effect from 19 January 1997 the definitive anti-dumping duty of 30.6% imposed on imports of bicycles originating in the mainland of China to imports of certain bicycle parts originating in the mainland of China. Bicycle assemblers in the EU could however request for exemption from the extended anti-dumping duty if they could prove, among other things, that their assembly operations did not circumvent the EU's anti-dumping duty imposed on bicycles originating in the mainland of China.
     
  2. Having examined the information provided by some assemblers requesting for exemption from the extended anti-dumping duty, the EC has established that the value of the parts originating in the mainland of China which were used in their assembly operations was lower than 60% of the total value of the parts used in these assembly operations. The EC therefore decided to exempt these assemblers from the extension of the anti-dumping duty imposed on imports of bicycles originating in the mainland of China to imports of certain bicycle parts originating in the mainland of China. The assemblers concerned and the effective date for exemption are listed in Article 1 of the decision.
     
  3. In relation, certain assemblers have ceased to exist or have stopped assembling bicycles. The EC therefore decided to revoke the exemption from the payment of the anti-dumping duty granted to these assemblers with effect from 25 July 2002. The assemblers concerned are listed in Article 2 of the decision.
