European Union (EU) * : Initiation of an Expiry Review of the Anti-dumping Measures on Imports of Certain Tube or Pipe-fittings of Iron or Steel Originating in, inter alia, the Mainland of China

Further to Commercial Information Circular No. 123/00 of 26 September 2000, the European Commission has initiated an expiry review of the anti-dumping measures on imports of certain tube or pipe-fittings of iron or steel originating in, inter alia, the mainland of China. A copy of the notice initiating the review is appended (pdf format) to this circular for reference. Details are set out below.

DETAILS

2. (a) Date of Notice : 3 April 2001
(b) Product Coverage : Certain tube or pipe-fittings (other than cast fittings, flanges and threaded fittings), of iron or steel (not including stainless steel), with a greatest external diameter not exceeding 609.6 mm, of a kind used for butt-welding or other purposes, classifiable within CN code ex 7307 9311, ex 7307 9319, ex 7307 9930 and ex 7307 9990 (these codes are given for information only).
(c) Procedures : In order to obtain necessary information for the investigation, the Commission will send questionnaires to the Community industry, any association of producers in the Community, exporters/producers in the mainland, any association of exporters/producers, importers, any association of importers named in the request for expiry review or which co-operated in the investigation leading to the measures subject to the present review, and the authorities of the mainland of China.

All interested parties who did not co-operate in the investigation leading to the measures subject to the present review should, within 15 days from 3 April 2001, request a copy of the questionnaire from the Commission in writing (not in electronic format, unless otherwise specified) indicating their name, address, e-mail address, telephone and fax and /or telex numbers. They may make their views known in writing (including submitting questionnaire replies), provide supporting evidence and apply to be heard by the Commission within 40 days from 3 April 2001 unless otherwise specified.

  1. The Commission initiated the review on the basis of a request lodged by the Defence Committee of EU Steel Butt-Welding Fittings Industry on 20 December 2000. The request was based on the grounds that there would be a recurrence of dumping and injury to the Community industry with the expiry of the anti-dumping measures.

  2. The existing anti-dumping measures will remain valid until completion of the review. Definitive anti-dumping duty has been imposed on certain tube or pipe-fittings of iron or steel originating in the mainland of China since 4 April 1996. The rate of duty is 58.6% of the net free-at-Community-frontier price before duty. Following an anti-circumvention investigation, the definitive anti-dumping duty has been extended to the same products consigned from Chinese Taipei whether declared as originating in Chinese Taipei or not since 15 April 2000.
