Commercial Information Circular No. 75/2008
The Mainland of China : Impending Expiry of Certain Anti-dumping Measures
The Ministry of Commerce (MOC) issued Notice No. 2/2008 on 15 January 2008 (Appendix (pdf format) ), announcing the impending expiry of the anti-dumping measures against imports of certain products. The annex to the notice lists out the originating countries, products concerned and the corresponding tariff codes of the General Administration of Customs, the respective expiry dates of the measures, etc.

According to the "Regulations on Anti-dumping", the duration of levying anti-dumping duty can be suitably extended if a review confirms that the removal of duty would likely cause the continuance or recurrence of injury to the domestic industries. As such, from the date of announcement and no later than 90 days before the expiry of the anti-dumping measures, domestic enterprises or their representatives may submit applications to the Ministry of Commerce to request for a review. The applications should include evidence that injury would be likely to continue or recur if the duty was removed.

If no application for a review is submitted according to the notice nor the Ministry of Commerce considers warrant initiating a review before the expiry date of the anti dumping measures, the anti-dumping measures against imports of the products concerned will be terminated after the expiry date.
