Australia : Initiation of an Investigation into Alleged Dumping and Subsidisation on Imports of Certain Toilet Paper from the Mainland of China, and Alleged Dumping from Indonesia
The Australian Customs Service has announced the initiation of an investigation into the alleged dumping and subsidisation on imports of certain toilet paper from the Mainland of China, and alleged dumping of the same product from Indonesia. Toilet paper in rolls with the following dimensions:

a maximum width of 120mm;
-
a diameter not exceeding 135mm; and
-
a perforated sheet size of approximately 110mm x 100mm.
Parent reels, folded toilet tissue and jumbo toilet rolls are excluded from the investigation.
The goods are classified under the tariff subheading 4818.10.00, statistical code 01 in Schedule 3 of Australia's Customs Tariff Act 1995. The goods from the Mainland of China and Indonesia are subject to rates of duty of 5%. |
| (c) Procedures |

The investigation period is 1 January 2007 to 31 December 2007. The Australian Customs Service (Customs) will examine exports to Australia of the goods during that period to determine whether dumping and/or subsidisation has occurred. Customs will examine details of the Australian market from 1 January 2004 for injury analysis.
Interested parties are invited to lodge submissions concerning the publication of the dumping and/or countervailing duty notice sought in the application no later than the close of business on 5 May 2008, addressed to:

Interested parties wishing to participate in the investigation must ensure that submissions are lodged promptly. Interested parties may be granted an extension of time for lodgement of a submission, provided the request is in writing and is reasonable and practical given the circumstances. Interested parties may reply to matters raised by other parties during the course of the investigation and in response to the statement of essential facts.
Interested parties claiming that information contained in their submission is confidential, or that the publication of the information would adversely affect their business or commercial interests, must:

provide a summary containing sufficient detail to allow a reasonable understanding of the substance of the information that does not breach that confidentiality or adversely affect those interests, or
-
satisfy the Chief Executive Officer (CEO) of the Australian Customs Service that there is no way such a summary can be given to allow a reasonable understanding of the substance of the information.
Submissions containing confidential information must be clearly marked "In-Confidence".
Interested parties must lodge a non-confidential version or a summary of their submission in accordance with the requirement above. In either case, interested parties must provide two copies of each for the public record. Customs further considers that there are a large number of suppliers of toilet paper from the Mainland of China and hence it may be necessary to select exporters for further investigation through a sampling procedure. |
| (d) Investigation Schedule |

A preliminary affirmative determination may be made not earlier than 60 days after the date of initiation. In accordance with section 269TD of Australia's Customs Act 1901 [Part XVB] (the Act), provisional measures, in the form of securities in respect of interim dumping duty and/or interim countervailing duty that may become payable on the goods, may be imposed where a preliminary affirmative determination has been made. |
| (e) Essential Facts |

The dates specified in the Australian Customs Service's notice for lodging submissions must be observed to enable Customs to report to the Minister for Home Affairs (the Minister) within the legislative timeframe. A statement of essential facts will be placed on the public record by 14 July 2008 (or by such later date as the Minister may allow in accordance with section 269ZHI of the Act). The statement will set out the essential facts on which the CEO proposes to base a recommendation to the Minister. That statement will invite interested parties to respond to the issues raised within 20 days of the statement being placed on the public record. |
| (f) Submissions on essential facts |

Submissions in response to the statement, received within the stated timeframes, will be taken into account in completing the report and recommendations to the Minister. Recommendations to the Minister will be made in a report on or before 28 August 2008 (or such later date as the Minister may allow), unless the CEO terminates the investigation. |
BACKGROUND
- The Australian Customs Service initiated the investigation following an application lodged by Kimberly-Clark Australia Pty Limited and SCA Hygiene Australasia Pty Ltd, on behalf of the Australian industry producing like goods. It is alleged that the goods from the Mainland of China and Indonesia have been exported to Australia at prices less than their normal value and that the dumping has caused material injury to the Australian industry. In addition, it is alleged that a countervailable subsidy has been received in respect of the goods exported from the Mainland of China to Australia causing material injury to the Australian industry.
