US : Use of Market Economy Input Prices in Nonmarket Economy Antidumping Proceedings
The United States Department of Commerce's International Trade Administration (ITA) issued in the Federal Register (FR) of 2 August 2013 a final rule to revise the method of valuing the price of inputs from market economy countries in antidumping proceedings involving nonmarket economy countries. DETAILS
2. The rule establishes a requirement that the input at issue be produced in one or more market economy countries, and a revised threshold requiring that "substantially all" (i.e., 85 percent) of the input be purchased from one or more market economy suppliers before the purchase price paid in market economy currency is used to value the entire input.
3. Furthermore, the rule requires that the input at issue be produced in a market economy, rather than merely being sold through a market economy supplier.
4. The final rule is effective 3 September 2013.
