US : Modification of a Ruling to the Tariff Classification of a Dry Suit

The US Customs and Border Protection (CBP) issued a notice on 26 June 2013 to modify a ruling NY N068477 concerning the tariff classification of a certain dry suit under the Harmonized Tariff Schedule of the United States (HTSUS). The CBP has also modified any treatment previously accorded by it to substantially identical transactions. This ruling is effective for merchandise entered or withdrawn from warehouse for consumption on or after 26 August 2012. The Notice is available at:

2. In the previous ruling NY N068477 issued on 6 August 2009, the CBP classified the subject garment, "Style MSD577vSR Tactical Operations Dry Suit," under HTSUS subheadling 6211.43.0010, which provides for "Track suits, ski suits and swimwear; other garments: Other garments, women's or girls': Of man-made fibers," subject to a duty rate of 16%.

3. In the latest ruling HQ H073928, CBP determined that the merchandise should be classified under HTSUS subheading 6210.50.50 instead as "Garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Other women's or girls' garments: Of man-made fibers: Other." The applicable rate of duty is 7.1% ad valorem.
