US : De Facto Criteria for Establishing a Separate Rate in Antidumping Proceedings involving Non-Market Economy Countries

The United States Department of Commerce (DoC) issued in the Federal Register (FR) of 5 July 2013 a final rule to implement modifications in the de facto criteria examined for purposes of determining whether to grant separate rate status to individual exporters in antidumping (AD) proceedings involving non-market economy (NME) countries with immediate effect. DETAILS

2. Traders had been informed via Commercial Information Circular No. 591/2010 of 17 December 2010 that the DoC was inviting public comments for its consideration on modifying the de facto criteria examined for purposes of determining whether to grant separate rate status to individual exporters in AD proceedings involving NME countries. This is one of the measures in the DoC's Trade Law Enforcement Package covering 14 proposals to strengthen the administration of the trade remedy laws of the United States, including the AD and countervailing duty (CVD) laws, in support of President Obama's National Export Initiative (NEI).

3. The final rule has now determined to implement certain modifications in the examination of de facto criteria as suggested by some of the comments received.
