Commercial Information Circular No. 540/2013
US : Consumer Products and Industrial Equipment Noncompliant with Applicable Energy Conservation or Labeling Standards Inadmissible
The United States Customs and Border Protection (CBP) published in the Federal Register (FR) of 5 July 2013 a final rule that amended regulations to provide that CBP would refuse admission into the customs territory of the United States to consumer products and industrial equipment products found to be noncompliant with applicable energy conservation and labeling standards.
2. The final rule further provided that upon notice from the Department of Energy or the Federal Trade Commission, CBP might conditionally release under bond to the importer such noncompliant products or equipment for purposes of reconditioning, re-labeling, or other action so as to bring the subject product or equipment into compliance. However, if the subject products or equipment were not brought into compliance timely, CBP would still refuse their admission.
