US : CPSC : Proposed Amendment of Regulation on Certificates of Compliance

The US Consumer Product Safety Commission (CPSC) issued in the Federal Register (FR) of 13 May 2013 a proposed rule to amend the existing regulation on certificates of compliance required to be submitted for imported and domestically-made consumer products.

DETAILS

2. The proposed amendment is intended to update the rule to clarify requirements in light of new regulations on testing and labeling pertaining to product certification, and component part testing. The following changes are proposed to be made:

- Importers have the obligation to certify finished products manufactured outside the US that are not delivered directly to US consumers. Foreign manufacturers would be responsible for certifying products that are delivered directly to consumers in the US.
- A children's product certificate or a general conformity certificate would only be required for finished products, or component parts sold directly to consumers.
- Date of initial certification, scope of products covered by the certificate, and attestation that the covered products are compliant with the applicable rules would have to be included in a certificate of compliance.
- Importers of regulated finished products manufactured outside the US and imported for consumption or warehousing would have to file the certificates of compliance electronically with the US Customs and Border Protection.
- All certificates of compliances and supporting test records would have to be kept for at least five years.
