Commercial Information Circular No. 822/2012

Brazil : Exemptions from Existing Conformity Certification Requirements for Safety Glass Used in Motor Vehicles and Motor Vehicle Wheels

The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of the Ministry of Development, Industry and Foreign Trade of Brazil issued Decree No. 401/2012 of 1 August 2012 and No. 421/2012 of 13 August 2012 to exempt certain safety glass used in motor vehicles and certain motor vehicle wheels from compliance with the existing conformity certification requirements.

2. Safety glasses and motor vehicle wheels to be exempted include:

• (a) safety glass

  (i)	for use in motor vehicle assembly lines;
  (ii)	for use in motor vehicles due to recall;
  (iii)	for motor vehicles whose production was discontinued on or before 31 December 1999;
  (iv)	intended exclusively for vehicles with a power-to-weight ratio greater than 140;
  (v)	intended exclusively for vehicles with a total gross weight no greater than 3.5 tonnes and a maximum power greater than 195 kW;
  (vi)	intended exclusively for vehicles with a total gross weight no greater than 3.5 tonnes and a minimum sales price of 250,000 Brazilian Real; and
  (vii)	otherwise covered by Decree No. 401/2012 that are imported as part of an assembled unit.

• (b) motor vehicle wheels

  (i)	for use in motor vehicles due to recall;
  (ii)	for vehicles whose production was discontinued on or before 31 December 1999;
  (iii)	designed exclusively for vehicles with a power-to-weight ratio greater than 140;
  (iv)	intended exclusively for vehicles with a total gross weight no greater than 3.5 tonnes and a maximum power greater than 195 kW; and
  (v)	intended exclusively for vehicles with a total gross weight no greater than 3.5 tonnes and a minimum sales price of 250,000 Brazilian Real.
