Commercial Information Circular No. 729/2012

Brazil : Mandatory Conformity Certification Requirements 

The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of the Ministry of Development, Industry and Foreign Trade of Brazil issued Decree No. 333/2012 on 2 July 2012 to clarify certain requirements of the products subject to mandatory conformity certification. The Decree came into force on the same day. 

2. Products subject to mandatory conformity certification requirements must display the INMETRO conformity seal clearly and visibly at the point of sale, in accordance with the specific conformity certification requirements for that particular product. The information included in the INMETRO conformity seal must be clear, accurate and in compliance with the established models. The conformity seal may not be removed or obstructed by any other information. 

3. If a product bearing an conformity seal is of potential hazard to human health or the environment, the supplier must report it to the INMETRO within 48 hours. The supplier has to inform the INMETRO of all remedy action within 10 calendar days. INMETRO may adopt other corrective actions if it considers the supplier’s action insufficient. Any recalls conducted by a supplier must be carried out in accordance with the current legislations.
