2 August 2012

Dear Sirs,

Commercial Information Circular No. 610/2012

US : Anti-dumping Action against Utility Scale Wind Towers from the Mainland of China : Preliminary Determination of Sales at Less than Fair Value

The US Department of Commerce (DoC) announced in the Federal Register (FR) notice of 2 August 2012 its preliminary determination that utility scale wind towers from the Mainland of China were being, or were likely to be, sold in the US at less than fair value. The weighted-average dumping margins were found to be 20.85% - 72.69%. DoC's final determination will be made no later than 135 days after publication of the preliminary determination. The FR notice is available at: http://www.gpo.gov/fdsys/pkg/FR-2012-08-02/pdf/2012-18929.pdf.

2. On 17 February 2012, the US International Trade Commission (ITC) published its preliminary determination that there was a reasonable indication that an industry in the US was threatened with material injury by reason of imports of utility scale wind towers from the Mainland of China. If the final determination of the DoC is affirmative, the ITC will make its final determination on whether the domestic industry in the US is materially injured, or threatened with material injury, by reason of the subject imports within 45 days after the DoC's final determination.
