Commercial Information Circular No. 359/2012

US : Modification to Regulation Concerning the Revocation of Anti-dumping and Countervailing Duty Orders

The US Department of Commerce (DoC) published in the Federal Register (FR) of 21 May 2012 a final rule amending its regulations concerning the revocation of anti-dumping (AD) and countervailing (CV) duty orders in whole or in part, and the termination of suspended AD and CV duty investigations. DETAILS

2.The trade was informed via Commercial Information Circular No. 180/2011 of 22 March 2011 the DoC's proposal regarding the subject modification. After considering comments received on the proposal, the DoC is now adopting the proposed changes in its final rule. 

3.In essence, the final rule eliminates the provision for revocation of an AD or CV duty order with respect to individual exporters or producers based on those individual exporters or producers having received AD rates of zero for three consecutive years, or CV duty rates of zero for five consecutive years. The final rule also corrects some grammatical and typographical errors in relevant provisions. 

4.The final rule is effective 20 June 2012, and will apply to all reviews that are initiated on or after this date.
