Commercial Information Circular No. 134/2012

US: CPSC's Amendment to Requirements for Consumer Registration of Durable Infant or Toddler Products

The US Consumer Product Safety Commission (CPSC) issued in the Federal Register (FR) of 17 February 2012 a notice amending its final rule on consumer registration of durable infant or toddler products. The FR notice is available at: http://www.gpo.gov/fdsys/pkg/FR-2012-02-17/pdf/2012-3712.pdf.

DETAILS

2. The trade was informed via Commercial Information Circular No. 665/2009 of 30 December 2009 the CPSC's final rule on requirements for consumer registration of durable infant or toddler products under Section 104(d) of the US Consumer Product Safety Improvement Act of 2008 (CPSIA). The Department subsequently issued Commercial Information Circular No. 484/2011 on 9 August 2011 notifying the trade the CPSC's proposed changes to the final rule.

3.The CPSC has now finalised the changes, which include -

  1. simplifying the provisions for the format and text of the registration form;

  2. for the required font size, specifying the physical measurement of the type rather than referring to "point";

  3. adopting changes to clarify that consumers should return only the bottom part of the registration form;

  4. allowing the manufacturer to list the brand name in addition to the manufacturer's name in the registration form;

  5. omitting the requirement that the manufacturer's name be stated along with the product information at the back bottom portion of the registration form;

  6. clarifying that if a manufacturer uses a third party to process the registration forms, the third party's name may be included as a "c/o" on the registration form;

  7. allowing the manufacturer the option of including a barcode, or other machine readable data in the registration form;

  8. correcting certain textual discrepancies for the purpose statement; and

  9. clarifying that it is not necessary to maintain registration information in the US. However, the registration records shall be made available within 24 hours upon a request by the CPSC.

4. The amendments are effective 18 February 2013.
