Commercial Information Circular No. 847/2011

Brazil : Procedures for Verification of Non-preferential Origin

The Secretariat of Foreign Trade (SECEX) of the Ministry of Development, Industry and Foreign Trade of Brazil has issued a Decree No. 39/2011 to establish the procedures for non-preferential origin verification during the import licensing phase, in particular for trade defence cases. The Decree (in Portuguese) has come into force on 16 November 2011, and is available at http://www.mdic.gov.br/arquivos/dwnl_1321539046.pdf.

2.The SECEX may, by means of risk assessment or subject to substantiated complaints, select for verification import licence applications which shall be subject to special procedure for non-preferential origin verification. The importer shall be notified by means of the Integrated Foreign Trade System (SISCOMEX) to submit the requisite information as set out in article 14 of the Decree within 20 days from the date of receipt of notification. Failure to prove the declared origin shall result in rejection of application for import licence, and the SECEX shall extend the measure to imports of identical products from the same or other exporter or manufacturer until compliance with the rules of origin. The special procedure for the verification of origin will be carried out within a maximum period of 180 days.
