US : Modifications to the Harmonized Tariff Schedule of the United States and Upland Cotton Special Import Quota

The US President signed a Proclamation to modify the Harmonized Tariff Schedule of the US (HTSUS) and the Upland Cotton Special Import Quota. The FR notice of 3 November is available at: http://www.gpo.gov/fdsys/pkg/FR-2011-11-03/pdf/2011-28727.pdf.

DETAILS

2. The Proclamation modifies chapter 64 of the HTSUS stipulating that no account shall be taken of textile materials which do not possess the characteristics usually required for normal use of an outer sole, including durability and strength for determining the constituent material of the outer sole of footwear. The modification will be effective with respect to goods entered, or withdrawn from warehouse for consumption, on or after the later of 1 September 2011 or the thirtieth day after publication of the Proclamation, i.e. 3 December 2011. Details are set out in Section A of Annex I of the Proclamation.

3. The Proclamation also modifies note 6 to subchapter III of chapter 99 of the HTSUS that the special import quota for cotton will take effect whenever the US average cotton price exceeds the prevailing world market price for ten consecutive weeks. The modification will be effective with respect to goods entered, or withdrawn from warehouse for consumption, on or after 18 June 2008. Details are set out at Annex III of the Proclamation.
