Commercial Information Circular No. 561/2011

Brazil : Mandatory Product Safety Certification Requirement for Certain Electrical Appliances

The trade was informed via Commercial Information Circular No. 133/2010 of 25 March 2010 that the Brazilian Government had established mandatory product safety certification requirements for certain domestically manufactured or imported electrical appliances in the Decree No. 371/2009 with effect from 1 July 2011. The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of Brazil has recently issued a separate Decree No. 328/2011 to clarify the scope of Decree No. 371/2009. DETAILS

2.The INMETRO determined that compressors, electric stoves, electric ovens (except those covered by International Electrotechnical Commission standards IEC 60335-2-36 and IEC 60335-2-42), microwave ovens covered by IEC 60335-2-90, hydromassage tubs, clothes dryers, dishwashers, wine cellars, freezers, hybrid accumulation heaters and heat pumps must comply with the requirements of Decree No. 371/2009.

3. The compliance dates to the requirements stipulated in Decree No. 371/2009 will be 1 July 2012 for the manufacture and import of the mentioned products; 1 July 2013 for the domestic sale of such products by manufacturers and importers; and 1 July 2014 for the domestic sale of such products by wholesalers and retailers.

EXEMPTION

4. Besides, the Decree No. 371/2009 will not apply to the following:

  1. centrifuges covered by IEC 60335-2-4, microwave ovens covered by IEC 60335-2-25, commercial electric furnaces covered by IEC 60335-2-36 and IEC 60335-2-42, pumps covered by IEC 60335-2-41 and IEC 60335-2-51, apparatus that expose the skin to UV and IR radiation covered by NBR IEC 60335-2-27, massage apparatus covered by IEC 60335-2-32, and projectors and similar equipment covered by IEC 60335-2-56;
  2. Class III devices which feed on safe, extra-low voltage that will not generate a higher voltage (excluding Class III devices powered by batteries that are recharged in the device itself through a base loader);
  3. multi-split type, duct and central air conditioners;
  4. certain kitchen appliances covered by IEC 60335-2-64; and
  5. products not covered by any specific parts of IEC 60335.
