Commercial Information Circular No. 532/2011

US : Supplementary Interim Final Rule on Certification of Factual Information during Antidumping and Countervailing Duty Proceedings

The US Department of Commerce (DoC) issued in the Federal Register (FR) of 2 September 2011 a supplementary interim final rule to supplement an interim final rule issued on 10 February 2011. The supplementary interim final rule has taken effective on 2 September 2011 and will remain in effect until such time as a final rule is published. Interested parties may submit comments in response to this rule to the DoC by 2 October 2011. The FR notice is available at: http://www.gpo.gov/fdsys/pkg/FR-2011-09-02/pdf/2011-22344.pdf.

DETAILS

2.Traders have been informed via Commercial Information Circular No. 110/2011 of the issuance of DoC's interim final rule on 10 February 2011, in support of the US President Obama's National Export Initiative (NEI), to amend its regulation which governs the certification of factual information submitted to the DoC by a person or his or her representative during antidumping (AD) and countervailing duty (CVD) proceedings in order to strengthen the certification requirements.

3.By this supplementary interim final rule, foreign governments will be allowed to submit certifications in either the format that was in use prior to the effective date of the February interim final rule or in the format provided in that rule. All other aspects of the February interim final rule remain in effect and fully apply to all parties and their counsel. Please refer to the above-mentioned FR for details of the supplementary interim final rule.
