Brazil : Mandatory Product Safety Certification Requirements for Various Automotive Components

The trade was informed via Commercial Information Circular (CIC) No. 259/2011 and CIC No. 439/2011 that the Brazilian Government has established mandatory product safety certification requirements for certain domestically manufactured or imported products. The Brazilian Government has recently issued a Decree to establish similar requirements for various automotive components. The Decree (in Portuguese) is available at:

DETAILS

2.The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of the Ministry of Development, Industry and Foreign Trade of Brazil issued Decree No. 301/2011 to require mandatory product safety certification for various automotive components for use in the spart parts market, including suspension shock absorbers, electric fuel pumps for Otto cycle engines, warning horns or similar equipment used in automotive road vehicles, extruded aluminium pistons, locking pins and rings, pistons rings, rod bearings and light bulbs for automotive vehicles.

3.The following automotive components are exempt from the certification requirements:

  1. components for use in automotive vehicle assembly lines;
  2. components for use in vehicles subject to recall; and
  3. components for vehicles, the production of which was discontinued prior to 31 December 1999.

4.Components with low import or production volumes for use in special vehicles, collectors' vehicles or special-purpose vehicles are deemed to be special components and subject to assessment by INMETRO with regard to the need to comply with the above certification requirements.

5.For automotive components covered by the certification requirements, the compliance dates will be as follows:

  Compliance Date Application Criteria
(i) 25 January 2013 manufacture and import of such products
(ii) 25 July 2013 domestic sale of such products by manufacturers and importers
(iii) 25 July 2014 domestic sale of such products by all other parties

6.For automotive components for vehicles, the production of which has been discontinued, the compliance dates are as follows:

  Compliance Date Application Criteria
(iv) a period of 36 months vehicle production discontinued after 1 January 2000 till 25 July 2011, and manufactured or imported before 25 January 2013
(v) same as the compliance date in (i) - (iii) to paragraph 5 vehicle production discontinued after 1 January 2000, and manufactured or imported after 25 January 2013
(vi) same as the compliance date in (i) - (iii) to paragraph 5 vehicle production discontinued before 31 December 1999, and compatible with automotive components refered to in (iv) and (v) 

7.The subject automotive components for domestic sale must obtain a valid registration form from INMETRO. The following information must be displayed on the package:

  • (I)month and year of manufacture; and
  • (II)model(s), brand(s) and year(s) of the vehicles to which the automotive parts apply.

8.For details of the above certification requirements, traders are advised to consult their importers in Brazil and/or the above Brazilian Decree.
