Brazil : Mandatory Product Safety Certification Requirements for Children's Cribs and New Tyres

The trade was informed via Commercial Information Circular No. 259/2011 that the Brazilian Government has established mandatory product safety certification requirements for certain domestically manufactured or imported products, including new tyres for use on motorcycles, scooters, mopeds and passenger cars. The Brazilian Government has recently issued two Decrees to extend the deadline for new tyres to comply with the requirements and establish such requirements for children's cribs. DETAILS

2.The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of the Ministry of Development, Industry and Foreign Trade of Brazil issued Decree No. 269/2011 to require mandatory product safety certification for certain domestically manufactured or imported children's cribs. The certification requirements will apply to children's cribs for domestic use, commercial establishments and/or suppliers of services which simulate a domestic environment, but will not apply to cribs used in hospitals. Cribs that can be converted into other items such as changing units, mini beds, enclosures and chests of drawers must also comply with the certification requirements.

3.Certification must be carried out by the Organismo de Certificação de Produto (Product Certification Organisation), accredited by the INMETRO, in accordance with the provisions set forth in the Decree. The Brazilian Government has established two different certification systems (Systems 5 and 7) for suppliers to choose for obtaining the certificate to ensure compliance with the applicable safety requirements for children's cribs. System 5 is based on type testing, the assessment and approval of the manufacturer's quality management system, and the testing of samples taken from the trade and the manufacturer while System 7 is based on batch testing.

4.For children's cribs covered by the certification requirements, the compliance dates will be 24 December 2012 for the manufacture and import of such products; 24 June 2013 for the domestic sale of such products by manufacturers and importers, and 24 June 2014 for the domestic sale of such products by all other parties.

5.The Brazilian Government has issued a separate Decree No. 267/2011 to extend the deadline for new tyres for use on motorcycles, scooters, mopeds and passenger cars to be sold in Brazil to comply with the certification requirements in accordance with the Decree No. 482/2010. The revised compliance dates will be 9 June 2012 for the manufacture and import of such products, 9 December 2012 for the domestic sale of such products by manufacturers and importers, and 9 June 2013 for the domestic sale of such products by all other parties.
