US : DoC's Final Rule on Electronic Filing Procedures in Antidumping and Countervailing Duty Proceedings

The US Department of Commerce (DoC) issued in the Federal Register (FR) of 6 July 2011 a final rule to amend its regulations governing the submission of information in antidumping (AD) and countervailing duty (CVD) proceedings. These amendments will incorporate changes resulting from the implementation of an electronic filing and document management program by the DoC, named the Import Administration Antidumping and Countervailing Duty Centralized Electronic Service System (IA ACCESS). The final rule will be effective from 5 August 2011 and apply to all AD/CVD proceedings that are active as at the effective date and that are initiated on or after the effective date. DETAILS

2.After reviewing the experiences gained during the IA ACCESS Pilot Program and comments received, the DoC issued the final rule to amend its regulations governing the submission of information in AD/CVD proceedings. Under this final rule, parties must file all AD/CVD submissions to the DoC electronically in accordance with the relevant regulations in Title 19 Code of Federal Regulations part 351 (19 CFR part 351). All documents and databases must be filed electronically using IA ACCESS at http://iaaccess.trade.gov, except for the following situations in which the documents and databases are to be filed manually:

  1. bulky documents over 500 pages;
  2. large database files over 20MB; or
  3. when the IA ACCESS suffers from technical failures in which the system is unable to accept filings continuously or intermittently over an hour between 12:00noon to 4:30pm (US Eastern Time (ET)) or for any duration of time between 4:30pm to 5:00pm (ET).

3.Any person making a filing must comply with the procedures set forth in the IA ACCESS Handbook on Electronic Filing Procedures (IA ACCESS Handbook), which is available at: https://iaaccess.trade.gov/help/Handbook%20on%20Electronic%20Filling%20Procedures.pdf.

4.Traders are strongly advised to go through the details of submission requirements and procedures in the above-mentioned FR notice and the IA ACCESS Handbook in order to comply with the necessary requirements.
