Commercial Information Circular No. 337/2011

Chile : Amended Labelling Requirements for Food Products

The Chilean Government issued a Decree (No. 88/2010) to make a number of amendments to its existing food safety regulations as set forth in the Decree No. 977/1996. Among others, it added two new paragraphs to Article 107(h) of Decree No. 977/1996 to require the inclusion of food allergens, and food ingredients/derivatives which could cause allergies in the list of ingredients of the food products. The amended labelling requirements will come into force on 6 January 2013. The Decree No. 88/2010 (in Spanish) is available at http://www.leychile.cl/Navegar?idNorma=1021822&idVersion=2011-01-06.

2.Specifically, the amendment required that:

  1. when the food, its ingredient or derivative contains or may contain one of the causes of food allergens officially recognised by the Ministry of Health of Chile (MoH), such allergens shall be identified in the list of ingredients, using a font size equal to or larger than that appearing on the general ingredients, or under the title "Contiene (Contains) ..." or similar. If the ingredient is derived from any of the allergens officially recognised by the MoH, both the ingredient and the allergen shall be labelled, an example is given: casein (milk) or milk casein;
  2. if the food product is at risk of allergen contamination from the food production or manufacturing process to its marketing, any of the following sentences shall be included after the list of ingredients to indicate the allergen in question: "Puede contener (May contain) ...", "Contiene pequeñas cantidades de (Contains small amounts of) ...", "Contiene trazas de (Contains traces of) ..." or "Elaborado en líneas que también procesan (Made in a way that also process) ...".

3.For details, traders are advised to consult their importers in Chile and/or the above Chilean Decree.
