Commercial Information Circular No. 259/2011

Brazil : Mandatory Product Safety Certification Requirements for Certain Products

The trade was informed via Commercial Information Circular No. 133/2010 that the Brazilian Government would require mandatory product safety certification for certain imported or domestically manufactured products according to a phased implementation schedule starting from 1 July 2011. The Brazilian Government has issued several Ministerial Decrees (MDs) to establish such certification requirements.

DETAILS

2.The National Institute of Metrology, Standardization and Industrial Quality (INMETRO) of the Ministry of Development, Industry and Foreign Trade of Brazil has issued five MDs to require mandatory product safety certification for certain domestically manufactured or imported products, including automotive wheels, school articles, new tyres, party articles, and mattresses and portable mats made of flexible polyurethane foam. Certification must be carried out by the Organismo de Certificação de Produto (Product Certification Organisation / OCP), accredited by the INMETRO, in accordance with the provisions set forth in the respective MD. Details are set forth below.

(i) Certification requirement for Automotive Wheels

Products covered : Steel and aluminium automotive wheels 
Relevant MD : MD No. 445/2010

Effective dates : 23 November 2011 for the manufacture and import of the products concerned; 23 May 2012 for the domestic sale of such products by manufacturers and importers; and 23 November 2013 for the domestic sale of such products by other parties.

(ii) Certification requirement for School Articles

Products covered : School articles for use by children younger than 14 years of age
Relevant MD : MD No. 481/2010

Effective dates  : 9 June 2012 for the manufacture and import of the products concerned; 9 June 2013 for the domestic sale of such products by manufacturers and importers; and 9 April 2014 for the domestic sale of such products by other parties.

(iii) Certification requirement for New Tyres for Use on Motorcycles, Scooters, Mopeds and Passenger Cars

Products covered : New tyres for use on motorcycles, scooters, mopeds and passenger cars, including mixed-use vehicles, goods vehicles, light goods vehicles and trailers

Effective dates : 9 June 2011 for the manufacture and import of the products concerned; 9 December 2011 for the domestic sale of such products by manufacturers and importers; and 9 December 2012 for the domestic sale of such products by other parties.

(iv) Certification requirement for Party Articles for use by Children

Products covered : Party articles for use by children younger than 14 years of age
Relevant MD : MD No. 006/2011

Effective dates : 5 July 2012 for the manufacture and import of the products concerned; 5 July 2013 for the domestic sale of such products by manufacturers and importers; and 5 May 2014 for the domestic sale of such products by other parties.

(v) Certification requirement for Mattresses and Portable Mats made of Flexible Polyurethane Foam

Products covered : Mattresses and portable mats made of flexible polyurethane foam
Relevant MD : MD No. 79/2011

Effective dates : 7 September 2013 for the manufacture and import of the products concerned; 7 March 2014 for the domestic sale of such products by manufacturers and importers; and 7 March 2015 for the domestic sale of such products by other parties.

3.For details of the above certification requirements, traders are advised to consult their importers in Brazil and/or the above Brazilian MDs (in Portuguese).
