US : CPSC Launches New Consumer Product Safety Information Database

The US Consumer Product Safety Commission (CPSC) issued a press release on 11 March 2011 announcing the full launch of the Publicly Available Consumer Product Safety Information Database (www.SaferProducts.gov). The press release is available at

DETAILS

2. The US Consumer Product Safety Act (CPSA), as amended by the US Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the CPSC to establish and maintain a database on the safety of consumer products, and other products or substances regulated by the CPSC. The database must be publicly available, searchable, and accessible through the CPSC's website. The CPSC issued the final rule to establish the database on 9 December 2010 and the trade was informed of this via Commercial Information Circular No. 578/2010. In accordance with the final rule adopted, the CPSC will review all online reports of harm filed by consumers and transmit the reports to the manufacturer named in the report within five business days where practicable. Manufacturers will then have 10 business days during which they may respond and provide comments and/or claims. At the end of the 10 day period, if all requirements are met, the reports and the manufacturer's comments will be posted on the database at www.SaferProducts.gov. Reports that potentially contain confidential information will have such information taken out before the reports are posted.

3. On 24 January 2011, the CPSC began registering businesses online, and accepting reports to test the system. Businesses which have signed up can receive a copy of a report of harm about their product via e-mail from CPSC should they be named in the report. Guidance videos on the operation of the database are available at www.SaferProducts.gov.
