US : CPSC's Final Rule on Safety Standards for Full-Size and Non-Full-Size Baby Cribs

The US Consumer Product Safety Commission (CPSC) issued in the Federal Register (FR) notice of 28 December 2010 a final rule on safety standards for full-size and non-full-size baby cribs as required by Section 104(b) of the US Consumer Product Safety Improvement Act of 2008 (CPSIA). Compliance with the final rule with respect to the offer or provision for use of cribs by child care facilities, family child care homes, and places of public accommodation affecting commerce is required starting on 28 December 2012. For all other entities subject to the final rule, compliance date will be starting on 28 June 2011. The FR notice is available at:

DETAILS

  1. The trade was informed via Commercial Information Circular No. 342/2010 that the CPSC issued a proposed rule on safety standard for full-size and non-full-size cribs for public comments. The final rule is essentially the same as the proposed rule with a few changes.

  1. The final rule on safety standards for full-size and non-full-size cribs that are substantially the same as voluntary standards developed by ASTM International (formerly known as the American Society for Testing and Materials). The standard for full-size cribs is substantially the same as a voluntary standard developed by ASTM, ASTM F 1169-10, Standard Consumer Safety Specification for Full-Size Baby Cribs, but with two modifications that strengthen the standard. The standard for non-full-size cribs is substantially the same as ASTM F 406-10a, Standard Consumer Safety Specification for Non-Full-Size Baby Cribs/Play Yards, but with four modifications that strengthen the standard. Details of the final rule, including the changes to the proposed rule and comments received from the public and responses of the CPSC, are set out in the above-mentioned FR notice.

The CPSC also issued FR notices on the same day to revoke its existing regulations pertaining to full-size and non-full-size cribs to eliminate duplication, and announce its accreditation requirements of third party conformity assessment bodies for testing baby cribs.
