US : CPSC's Decision to Lift the Stay of Enforcement of Certification Requirements for Certain Non-Children's Products

The US Consumer Product Safety Commission (CPSC) published a notice in the Federal Register (FR) of 27 December 2010 to announce that the stay of enforcement of the certification requirements for non-children's vinyl plastic film, carpets and rugs, and clothing textiles as stipulated in Section 102(a) of the US Consumer Product Safety Improvement Act of 2008 (CPSIA) will be lifted as of 26 January 2011. A copy (pdf format) of the FR notice is appended to this circular for reference.

DETAILS

  1. The trade was informed via Commercial Information Circular No. 657/2009 that the CPSC announced on 28 December 2009 its decision to extend its stay of enforcement of testing and certification requirements for certain non-children's products (including vinyl plastic film, carpets and rugs, and clothing textiles) until 10 February 2011. 
     

  2. The CPSC explained in its decision of 28 December 2009 that it intends to require testing and certification of these products once it completes the rulemakings associated with the products, issues notices of requirements, or otherwise resolves the issues that have warranted a continuation of the stay of enforcement for the products. In July and August 2010, the CPSC issued in the FR notices of requirements for vinyl plastic film, carpets and rugs, and clothing textiles as follows:

As the factor preventing the stay from being lifted no longer exists, the CPSC now announced to lift the stay of enforcement of the certification requirements with respect to non-children's vinyl plastic film, carpets and rugs, and clothing textiles. 

  1. After 26 January 2011, every manufacturer (including private labellers) of such product that is imported for consumption or warehousing or distributed in commerce must issue a certificate for that product, which is based on a test of each product, or upon a reasonable testing program that the product complies with all rules, bans, standards, or regulations applicable to the product under the US Consumer Product Safety Act or any other law enforced by the CPSC. The certificate must specify each such rule, ban, standard, or regulation applicable to the product.
