Dear Sirs,
Commercial Information Circular No. 604/2010
US : Truth in Fur Labeling Act of 2010
The Truth in Fur Labeling Act of 2010 (H.R. 2480) (the Act) was signed by the US President into law on 18 December 2010 that would amend the US Fur Products Labeling Act (FPLA) to require labelling of all fur garments, regardless of value. The Act will take effect 90 days after the date of the enactment of the Act. Full text of the Act is available on the website of the Library of US Congress at
http://www.gpo.gov/fdsys/pkg/BILLS-111hr2480enr/pdf/BILLS-111hr2480enr.pdf.
DETAILS
-
The FPLA currently exempts from labelling any garments with a "relatively small quantity or value" of fur, meaning any animal fur valued at US$150 or less. Full text of the FPLA is available at http://www.ftc.gov/os/statutes/textile/furact.htm.
-
With the passage of the Act, the aforesaid exemption will be removed. The FPLA will require labelling for all fur garments, regardless of value. It however will include an exemption for discrete sales by non-retailers that covers fur products (a) the fur of which was obtained from an animal through trapping or hunting; and (b) when sold in a face to face transaction at a place such as a residence, craft fair, or other location used on a temporary or short term basis, by the person who trapped or hunted the animal, where the revenue from the sale of apparel or fur products is not the primary source of income of such person.
