US : CPSC's to Extend the Date of Testing and Certification of Youth All-Terrain Vehicles

The US Consumer Product Safety Commission (CPSC) published in the Federal Register (FR) of 9 December 2010 a notice to announce an extension of 60 days, from 26 November 2010 to 25 January 2011, on which manufacturers (including importers) of youth all terrain vehicles (ATVs) must submit sufficient samples of such products to a third party conformity assessment body approved by the CPSC for testing and, based on such testing, issue a certificate that the products manufactured comply with certain CPSC regulations relating to youth ATVs. Traders have been informed via Commercial Information Circular No. 390/2010 that the CPSC issued in the FR of 27 August 2010 a notice of requirements that provided the criteria and process for CPSC's acceptance of accreditation of third party conformity assessment bodies for testing of youth ATVs. The notice also stated that, for youth ATVs manufactured after 26 November 2010, the manufacturer (including the importer) or private labeller must issue a certificate of compliance with the applicable CPSC regulations based on testing preformed by a third party conformity assessment body accredited to do so.

Due to insufficient number of third party conformity assessment bodies accredited by the CPSC for testing youth ATVs, the CPSC decides to extend the date for implementation of the testing and certification requirements by 60 days, i.e. to 25 January 2011. Each manufacturer (including the importer) or private labeller of youth ATVs manufactured after 25 January 2011 must have samples of such products, or samples that are identical in all material respects to such products tested by a third party conformity assessment body accredited to do so by the CPSC, and based on that testing, issue a certificate of compliance with the applicable CPSC regulations. Other dates contained in the conditions for accreditation of third party conformity assessment bodies for testing of youth ATVs have also been adjusted accordingly. Traders are reminded that, except the adjustment in dates, all provisions of the notice of requirements published on 27 August 2010 remain in effect.
