US : Final Rule on Certification, Compliance, and Enforcement Requirements for Certain Consumer Products and Commercial and Industrial Equipment under the Energy Conservation Program
The US Department of Energy (DoE) issued in the Federal Register (FR) notice of 5 January 2010 a final rule to adopt regulations to implement reporting requirements for energy conservation standards and energy use, and to address other matters, including compliance certification, prohibited actions, and enforcement procedures for specific consumer products and commercial and industrial equipment including ceiling fans, ceiling fan light kits, dehumidifiers, medium base compact fluorescent lamps, torchieres, unit heaters, automatic commercial ice makers, commercial prerinse spray valves, traffic and pedestrian signal modules, distribution transformers, certain types of commercial refrigerators, freezers, and refrigerator-freezers, commercial heating, air-conditioning, and water heating equipment. Except certain products, the final rule will be effective on 4 February 2010.

According to the final rule, each manufacturer of covered products/equipment is required to file a compliance statement and certification reports. The compliance statement is essentially a one-time filing in which the manufacturer or private labeller states that all basic models currently produced, as well as any basic models manufactured in the future, are (or will be) in compliance with applicable energy conservation requirements. The certification reports will generally provide the efficiency, or energy or water use, as applicable, for each covered basic model that a manufacturer or private labeller distributes. The effective dates of filing compliance statements and certification reports as well as other details of the final rule are set out in the FR notice.
