US : United States Manufacturing Enhancement Act of 2010

The United States Manufacturing Enhancement Act of 2010 (H.R. 4380) (the Act), also known as the Miscellaneous Trade Bill, was signed by the US President into law on 11 August 2010 to provide duty suspensions and reductions until 31 December 2012, retroactive to 1 January 2010, for hundreds of imported manufacturing inputs including yarns, fibres, footwear, household electrical appliances, chemicals, etc.

DETAILS

  1. The Act extended and/or revised hundreds of duty suspensions and reductions on imported goods that expired on 31 December 2009 and created new duty suspension and reduction provisions under Harmonized Tariff Schedule (HTS) 9902. Both new and extended/revised duty suspension and reduction provisions in the Act would expire on 31 December 2012.
     

  2. All of the HTS 9902 changes in the Act are effective for goods entered or withdrawn from warehouse for consumption on or after the 15th day after the date of enactment (i.e., around 26 August 2010). Goods entered or withdrawn from warehouse for consumption on or after 1 January 2010 but before the effective date, that would have qualified for HTS 9902 treatment had the appropriate provision not expired, would be eligible to be liquidated or reliquidated as if the entry had been made after the effective date of the Act.
     

  3. A liquidation or reliquidation may be made with respect to an entry only if a request is filed with US Customs and Border Protection (CBP) not later than 180 days after the date of enactment of the Act (i.e. around 7 February 2011). The request must contain sufficient information to enable CBP to locate or reconstruct the entry.
     

  4. The US Office of Textiles and Apparel has created a new database which helps search for reduced tariff rates for particular textiles and clothing products. It is accessible via http://web.ita.doc.gov/tacgi/legislation.nsf/$$searches_MTB?OpenForm.
