Mexico : Anti-dumping Action against Denim Originated in or Exported from Hong Kong

The Department has received information that the Mexican Ministry of Economy (MMoE) has published a notice in the Official Gazette of 12 August 2010 to announce the initiation of an expiry review on the anti-dumping (AD) duty order on denim originating in or exported from Hong Kong. Interested parties are invited to participate in the review by completing the official questionnaire within 28 working days from the date of publication of this notice. BACKGROUND

  1. Since September 1991, denim of 85% cotton or more from Hong Kong and imported into Mexico is subject to an AD duty of US$1 per kilogram unless they are exported by Hong Kong companies specifically exempted by the Mexican authorities. The last expiry review in 2005 resulted in an extension of the AD order until August 2010. On 11 November 2009, the MMoE invited domestic producers in Mexico and interested parties to file request by 8 July 2010 for initiating an expiry review. The Department has issued Commercial Information Circular No. 592/2009 on 27 November 2009 to inform the trade of this.

DETAILS OF THE EXPIRY REVIEW

  1. In response to requests filed by Mexican domestic producers of denim, the MMoE decided to initiate the expiry review on the AD order. The review is to determine whether the AD duty should be retained, removed or updated according to the latest circumstances in accordance with the relevant provisions of the applicable Mexican laws. The details of the expiry review are as follows:

  1. The product covered is denim fabric classified under subheading 5209.42.01 of the Harmonized Tariff Schedule of Mexico, i.e. woven denim fabric containing 85% cotton or more by weight, weighing more than 200g/m2, originated in or exported from Hong Kong.

  2. The period of review is from 1 July 2009 to 30 June 2010.

  3. The period for analysis of injury to the Mexican domestic industry is from 1 January 2006 to 30 June 2010.

  1. According to the Official Gazette, interested parties, including domestic producers, importers, exporters, foreign legal entities or any person deemed to have interest in the outcome of the review are invited to participate by completing the official questionnaire provided for this review with the arguments and evidence they consider relevant. As mentioned in paragraph 34 of the Official Gazette, the official questionnaires can be obtained from the website of the MMoE at http://www.economia.gob.mx or the office of the International Trade Practices Unit of the MMoE during 9:00 - 14:00, Monday to Friday, at :

    The official questionnaire must be completed in Spanish and returned directly to the MMoE within 28 working days from the date of the publication of this notice.

  1. Please be reminded that the AD order remains in force while the expiry review is underway.

  1. Exporters of denim which is covered by the AD order are encouraged to consider participating in the expiry review. They should also check with their respective importers in the Mexico to ensure that proper procedural steps are followed to register their interest and for participation in the expiry review.
