Commercial Information Circular No. 353/2010

US : Extension of Import Restrictions against Burmese products

The US President signed into law on 27 July 2010 to extend for one year the import restrictions contained in the Burmese Freedom and Democracy Act of 2003. The relevant Public Law No. 111-210 can be found at the website of the Library of the US Congress at http://thomas.loc.gov/cgi-bin/bdquery/z?d111:HJ00083:|TOM:/bss/d111query.html.

  1. These restrictions include a ban on the importation of all products of Burma that are imported directly or indirectly into the US, which applies to :

    1. merchandise intended for commercial and personal use, including gifts or informational materials;

    2. merchandise landed, but not entered for consumption, in the U.S. (e.g., goods placed in a foreign-trade zone or bonded warehouse); and

    3. imports for transshipment or in-transit movements of products of Burma intended or destined for a third country.

The ban does not apply to :

  1. merchandise for which the Office of Foreign Assets Control has issued an import license, which may be entered for consumption or in-transit movement through the US, or 

  2. importations for US or foreign diplomatic and consular officials.

  1. Traders are advised to read in conjunction Commercial Information Circular No. 137/2010 of 26 March 2010 for prohibitions and conditions for importation of Burmese and non-Burmese covered articles of jadeite, rubies, and articles of jewelry containing jadeite or rubies.
