US : CPSC's Action on the Extension of the Stay of Enforcement of Testing and Certification Requirements for Bicycles

The US Consumer Product Safety Commission (CPSC) published in the Federal Register (FR) a notice of 17 June 2010 to announce an extension of the stay of enforcement of testing and certification requirements for bicycles until 14 August 2010. A copy (pdf format) of the FR notice is appended to this circular for reference.

 

DETAILS

  1. The trade was informed via Commercial Information Circulars No. 70/2009 and 657/2009 that the CPSC published in the FR notices of 9 February 2009 and 28 December 2009 announcing the stay of enforcement of certain testing and certification requirements, pursuant to the US Consumer Product Safety Act (CPSA) as amended by the US Consumer Product Safety Improvement Act of 2008 (CPSIA), for certain products and the revisions to the terms of the stay. Bicycles are among the products subject to the stay of enforcement and the stay was extended until 17 May 2010.

  1. In view of the insufficient laboratory capacity for third party testing of bicycles, the CPSC decided to further extend the stay of enforcement of testing and certification requirements for both children and non-children bicycles until 14 August 2010. The CPSC also announced two exceptions to the extension of the stay : (i) the stay of enforcement for bicycle reflectors has been extended until 14 November 2010; and (ii) bicycles with non-quill-type stems are excluded from the testing and certification requirements until further notice.
