Commercial Information Circular No. 147/2010

US : Final Rule on CPSC's Interpretation of the Civil Penalty Factors

The trade was informed via Commercial Information Circular No. 446/2009 that the US Consumer Product Safety Commission (CPSC) issued on 1 September 2009 an interim final rule providing its interpretation of the civil penalty factors found in the US Consumer Product Safety Act, the US Federal Hazardous Substances Act, and the US Flammable Fabrics Act, as amended by Section 217 of the US Consumer Product Safety Improvement Act of 2008 (CPSIA), and to seek public comments. As a result of the comments received and review of the interim final rule, the CPSC issued its final rule in the Federal Register (FR) notice of 31 March 2010 to clarify certain information and terms. The final rule has become effective on 31 March 2010. A copy (pdf format) of the FR notice is appended to this circular for reference.
