Mexico : Elimination of Anti-dumping Duties on Certain Apparel Products
from the Mainland of China

The Mexican Ministry of Economy published a notice in the Official Gazette of 20 May 2009 to announce its decision to eliminate the anti-dumping (AD) duties on certain apparel products originating in the Mainland of China as a preliminary result of an AD administrative review. The Gazette notice (in Spanish) is available at

  1. The trade was informed via Commercial Information Circular No. 543/2008 that Mexico and the People's Republic of China signed an agreement on trade remedy measures on 1 June 2008, under which Mexico will eliminate or gradually reduce the AD duties it currently maintains on the products originating in the Mainland of China. However, the AD duties on certain apparel products remained in force.

  2. The Mexican Ministry of Economy initiated in late 2007 an AD administrative review on a range of products from the Mainland of China, including certain apparel products. Given that no domestic producers provided evidence of dumping or injury, the Mexican Ministry of Economy decided to rescind the AD duties on certain apparel products. According to the Gazette notice, amongst other things, the following measures will take effect on 21 May 2009:

  • Imports of Mainland China's apparel products classified under subheadings 6109.10.01, 6109.90.01, 6109.90.99 and 6110.20.99 of the Harmonized Tariff Schedule of Mexico (HTSMX) are no longer subject to 533 percent AD duties [please refer to paragraph 136 of the Gazette notice for details];

  • In addition to regular Most-Favoured-Nation (MFN) duties (the current rate is 30 percent), Mainland China's apparel products classified under HTSMX subheadings 6109.10.01, 6109.90.01 and 6110.20.99 are now subject to transition duties of 130 percent. These duties will fall to 120 percent in 2010, to 80 percent in 2011 and the duties will be entirely eliminated no later than 11 December 2011 [please refer to paragraphs 28, 30, 31 and 32 of the Gazette notice for details]; and

  • Mainland China's apparel products classified under HTSMX subheading 6109.90.99 is not subject to transition duties. It is only subject to the regular MFN rate, currently 30 percent [please refer to paragraphs 29, 31 and 32 of the Gazette notice for details].
