Commercial Information Circular No. 131/2009

US : Final Rule on Procedures and Requirements for CPSC Determinations or Exclusions Regarding Lead Content Limits of Materials or Products under the Consumer Product Safety Improvement Act of 2008 

The US Consumer Product Safety Commission (CPSC) issued in the Federal Register (FR) notice of 11 March 2009 a final rule on procedures and requirements on requests for (1) a CPSC determination that a commodity or class of materials or a specific material or product does not exceed the lead content limits specified under Section 101(a) of the US Consumer Product Safety Improvement Act of 2008 (CPSIA); or (2) an exclusion of a commodity or class of materials or a specific material or product under Section 101(b)(1) of the CPSIA, that exceeds the lead content limits under Section 101(a) of the CPSIA, but which will not result in the absorption of any lead into the human body nor have any other adverse impact on public health or safety. This final rule has become effective on 11 March 2009. A copy (pdf format) of the FR notice is appended to this circular for reference.

The trade was informed via Commercial Information Circular No. 43/2009 that the CPSC published a notice in the FR of 15 January 2009 to seek public comments on its proposed rulemaking on procedures and requirements for future CPSC determinations or exclusions regarding lead content limits of materials or products. The CPSC has received several comments in response to the proposed rule and is now issuing the final rule. Details of the final rule are set out in the FR notice.
