Commercial Information Circular No. 110/2009

US : Tracking Labels for Children's Products under Section 103 of the Consumer
Product Safety Improvement Act of 2008

The US Consumer Product Safety Commission (CPSC) published in the Federal Register (FR) of 26 February 2009 a notice requesting comments and information about implementation of tracking labels for children's products specified in Section 103 of the US Consumer Product Safety Improvement Act of 2008 (CPSIA). Interested parties may submit comments to CPSC by 27 April 2009. A copy (pdf format) of the FR notice is appended to this circular for reference.

DETAILS

  1. Section 103 of the CPSIA requires, effective 14 August 2009, the manufacturer of a children's product must place permanent distinguishing marks on the product and its packaging, to the extent practicable, that will enable (a) the manufacturer to ascertain the location and date of production of the product, cohort information (including the batch, run number, or other identifying characteristic), and any other information determined by the manufacturer to facilitate ascertaining the specific source of the product by reference to those marks; and (b) the ultimate purchaser to ascertain the manufacturer or private labeller, location and date of production of the product, and cohort information (including batch, run number, or other identifying characteristic). The CPSC is now requesting comments and information about implementation of this requirement.

The brief summary and FAQs were prepared by the CPSC staff and have not been reviewed or approved by, and may not necessarily reflect the views of the CPSC.
