US : Adjustment of Certain 2007 Quota Limits and Establishment of 2008 Quota Limits under the US/Mainland Memorandum of Understanding on Textiles

The US Committee for the Implementation of Textile Agreements (CITA) has issued Federal Register (FR) notices to announce the adjustment of 2007 quota limits of two categories and the establishment of 2008 quota limits of the 34 categories of textile and apparel products covered by the US/Mainland Memorandum of Understanding concerning Trade in Textile and Apparel Products (MOU). The adjusted 2007 quota limits took effect from 30 November 2007 while the 2008 quota limits will be effective as of 1 January 2008

DETAILS

  1. The US/Mainland MOU signed by the US and the Mainland on 8 November 2005 has established import restraints for 21 groups involving 34 categories of Mainland-origin textiles and apparel products for a period of 3 years starting from 1 January 2006, and extending through 31 December 2008. Pursuant to the MOU, CITA announced the adjustment to 2007 quota limits for carryover (i.e. borrowing quotas from the previous year) in August 2007. Details are set out in Commercial Information Circular (CIC) No. 302/2007 of 9 August 2007. CITA recently announced that, effective 30 November 2007, the 2007 quota limits for Category 345/645/646 (sweaters) and Category 352/652 (underwear) would be increased for carryforward (i.e. borrowing quotas from the following year). A copy of the FR notice is appended at Annex A (pdf format). 

  2. In a separate FR notice, CITA also announced the establishment of 2008 quota limits which will be effective as of 1 January 2008. The quota levels may be adjusted during the course of the year for carryover and/or carryforward. The 2008 quota limits for Categories 345/645/646 and 352/652 have been adjusted downwards to reflect the carryforward applied to 2007 limits.   3. CITA also mentioned in the FR notice that baby socks in subheading 6111.20.6050, 6111.30.5050 and 6111.90.5050 of the US Harmonized Tariff Schedule (HTS) shall be counted in dozen pairs for quota purpose. These baby socks are subject to the quota level for 332/432/632-T and the sublevel for 332/432/632-B, but the correct Category designation 239 will be required at the time of entry for quota purpose.
