Commercial Information Circular No. 358/2007

US : Interpretive Rule Concerning Classification of Unisex Footwear

Commercial Information Circular (CIC) No. 280/2006 of 25 July 2006 informed traders of a proposal by the US Customs and Border Protection (CBP) to introduce new criteria to determine whether footwear should be considered to be "commonly worn by both sexes" (unisex) for tariff classification purposes. Upon due consideration of the comments received, the CBP announced in the Federal Register (FR) notice of 20 September 2007 adopting the proposed interpretive rule as final, with only minor edits. The rates of duty applicable to footwear "For other persons" (i.e., "unisex") are about 1.5 percent higher than the rates of duty applicable to footwear "For men, youths and boys." The new criteria will take effect on 22 October 2007. A copy (pdf format) of the FR notice setting out the details of the final rule is appended to this circular for reference.
